The New York Post has reached a settlement with GlaxoSmithKline with the makers of Nexium, a heartburn medication used to treat heartburn that has been linked to the company’s failure to pay a price for its popular drug.
“The company, which has been in a legal battle with the makers of Nexium for years, is now the first to file a motion for a summary judgment with the U. S. District Court of New Jersey,” according to a document today from the New York Post. “The court will decide whether or not GlaxoSmithKline is liable to its manufacturer.
“As the company’s legal battle against the maker of Nexium has been ongoing, the court has decided that the companies’ respective suits should be dismissed on the basis that the makers have failed to adequately prove the absence of market competition and that they have been the consumers of the drug,” the document states.
“While the court is in the early stages of the litigation, the outcome of that litigation could be influenced by the fact that some of the generic makers have sued to protect the company’s financial interests. This is a potential conflict of interest that will have to be settled by the court in order to avoid any potential conflict with GlaxoSmithKline.”
According to the document, the New York Post has reached a settlement with the makers of the drugs in the first instance, but it is unclear if any of the companies will join that settlement. The Post’s lawsuit is currently under review by the U. Department of Justice.
